By accessing or using HandyPal's website accessibility service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

2. Description of Service

HandyPal provides:

• An accessibility widget that can be embedded on your website
• Accessibility auditing and compliance scanning
• Accessibility reports and recommendations
• Dashboard for managing multiple websites
• Analytics on accessibility feature usage (retained for approximately 30 days)
• Compliance certificates and documentation

Data Retention: Widget analytics data is automatically retained for approximately 30 days and permanently deleted thereafter to minimize data collection and storage.

3. Account Registration

To use our Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental consent
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Subscription and Payment

4.1 Free Trial

We offer a 7-day free trial for new customers. A valid credit card is required to start the trial. You will be charged automatically when the trial ends unless you cancel before the trial period expires.

4.2 Subscription Plans

Subscriptions are billed monthly or annually based on your selected plan. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice to existing customers.

4.3 Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months or unused service.

We want you to be happy with HandyPal! We offer a 30-day money-back guarantee to give you peace of mind. If you experience technical difficulties with our widget working properly on your website within the first 30 days, just contact our support team at support@handypal.net.

We'll work with you to troubleshoot the issue. If we can't get it working properly due to a technical limitation on our end, we'll provide a full refund. Please note that this guarantee covers technical functionality issues with our service—things like configuration challenges specific to your site's unique setup, third-party plugin conflicts, or general change of business needs would fall outside this guarantee. We're here to help make accessibility work for you!

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service to harass, abuse, or harm others
• Resell or redistribute the Service without authorization
• Remove or modify any proprietary notices

6. Intellectual Property

HandyPal retains all rights, title, and interest in the Service, including all software, technology, content, and trademarks. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

7. Your Content and Data

You retain ownership of all content and data you provide to the Service. By using our Service, you grant us a license to:

• Host, store, and process your data to provide the Service
• Create anonymized, aggregated analytics
• Use your feedback to improve the Service

You are responsible for ensuring you have the right to use any content you provide and that it complies with applicable laws.

8. Service Availability

We strive to maintain 99.5% uptime but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.

9. Compliance and Warranties

Important: While HandyPal helps improve website accessibility and compliance with WCAG 2.1 AA standards, we do not guarantee complete legal compliance or immunity from accessibility lawsuits. You are responsible for:

• Reviewing and addressing accessibility issues identified in our reports
• Ensuring your website meets all applicable legal requirements
• Consulting with legal counsel regarding compliance obligations
• Implementing fixes for identified accessibility barriers

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCESSPAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless HandyPal from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that should survive termination will remain in effect.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in San Francisco County, California.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
